Public Notice: Amending Chapter 96 and Adopting and Completing the required inserts in the 2015 Edition of certain codes and repeal certain regulations that are inconsistent therewith

PUBLIC NOTICE

Notice is hereby given that the Board of Supervisors of Upper Southampton Township, County of Bucks, Commonwealth of Pennsylvania, will hold a public hearing on October 2, 2018 at 6:30 PM in the Southampton Free Library, lower level meeting room, 947 Street Road, Southampton, PA 18966 to consider adoption of the following ordinance:

AN ORDINANCE OF THE TOWNSHIP OF UPPER SOUTHAMPTON, COUNTY OF BUCKS, COMMONWEALTH OF PENNSYLVANIA AMENDING CHAPTER 96 OF THE CODE OF ORDINANCES OF THE TOWNSHIP OF UPPER SOUTHAMPTON ADOPTING AND COMPLETING THE REQUIRED INSERTS IN THE 2015 EDITIONS OF THE FOLLOWING CODES: INTERNATIONAL BUILDING, INTERNATIONAL MECHANICAL, INTERNATIONAL FUEL GAS, INTERNATIONAL PLUMBING, INTERNATIONAL FIRE, INTERNATIONAL ENERGY CONSERVATION, INTERNATIONAL EXISTING BUILDING, INTERNATIONAL PERFORMANCE, INTERNATIONAL URBAN-WILDLAND AND INTERNATIONAL RESIDENTIAL AND REPEAL CERTAIN REGULATIONS THAT ARE INCONSISTENT THEREWITH.

AN ORDINANCE OF THE TOWNSHIP OF UPPER SOUTHAMPTON, COUNTY OF BUCKS, COMMONWEALTH OF PENNSYLVANIA AMENDING CHAPTER 96 OF THE CODE OF ORDINANCES OF THE TOWNSHIP OF UPPER SOUTHAMPTON ADOPTING AND COMPLETING THE REQUIRED INSERTS IN THE 2015 EDITIONS OF THE FOLLOWING CODES: INTERNATIONAL BUILDING, INTERNATIONAL MECHANICAL, INTERNATIONAL FUEL GAS, INTERNATIONAL PLUMBING, INTERNATIONAL FIRE, INTERNATIONAL ENERGY CONSERVATION, INTERNATIONAL EXISTING BUILDING, INTERNATIONAL PERFORMANCE, INTERNATIONAL URBAN-WILDLAND AND INTERNATIONAL RESIDENTIAL AND REPEAL CERTAIN REGULATIONS THAT ARE INCONSISTENT THEREWITH.

WHEREAS, the Township of Upper Southampton elected to administer and enforce the provisions of the Pennsylvania Construction Code Act, Act 45 of 1999, as amended from time to time, and its regulations and adopted the Uniform Construction Code contained in 34 Pa. Code, Chapters 401-405 as amended from time to time, in order to promote the general health, safety and welfare of the citizens of the Township of Upper Southampton, County of Bucks, Commonwealth of Pennsylvania and to conform to the requirements of the Pennsylvania Construction Code Act and regulations to the Act promulgated by the Pennsylvania Department of Labor and Industry (hereinafter sometimes collectively referred to as the “Code”); and

Whereas, the Township of Upper Southampton wishes to update and complete the required inserts in the editions of the Codes set forth below as well as and repeal certain regulations that are inconsistent therewith.

NOW, THEREFORE, the Board of Supervisors of the Township of Upper Southampton does hereby enact and ordain the following:

Section 1. The Code of Ordinances of the Township of Upper Southampton is hereby amended by the deletion of §73-2.B. and §73-3. of Chapter 73 titled “Uniform Construction Codes” in its entirety. In place of the said deleted §73-2.B. and §73-3., the following §73-2.B. and §73-3. shall be inserted:

§73-2.B.

B. Portions of the said Uniform Construction Code require certain information to be provided which is unique to individual municipalities. Accordingly, the following information is provided to complete the Code:

(1) International Building Code, 2015 Edition.

(a) Section 101.1 Insert: Township of Upper Southampton

(b) Section 1612.3. Insert: Township of Upper Southampton.

(c) Section 1612.3. Insert: May 18, 1999.

 

(2) International Mechanical Code 2015.

(a) Section 101.1. Insert: Township of Upper Southampton

(b) Section 106.5.2. Insert: Latest fee schedule as adopted by Resolution by the Board of Supervisors of the Township of Upper Southampton.

(c) Section 106.5.3. Insert: “75%” to “75%”.

(e) Section 108.5. Insert: “$500.00”, “$1,000.00.”

(3) International Fuel Gas Code 2015.

(5) International Fire Code 2015.

Insert: Smoke and/or Heat Detector Regulations for Use Groups other than Residential. A listed and labeled smoke and/or heat detection system, which shall be approved by the Code Enforcement Officer, shall be installed and maintained to protect every room of the entire premises in all places of public assembly, including, inter alia, restaurants, bowling lanes, shopping malls, shopping centers, including merchandising marts, indoor places of amusement, including sport arenas or rinks, clubs, lodges or fraternal organizations, YMCA’s or similar occupancies, lumber yards and builder’s supply, and all other office, commercial or industrial property and associated occupancies within the same structure, having a total floor area greater than 200 square feet and for which an occupancy permit is required. All detectors in the system shall be interlocked and coupled to means for producing an alarm of at least 85 dbA throughout the entire premises. The provisions of this section shall not apply to those structures encompassed by these sections, which are protected throughout by a sprinkler system approved by the Building Code Official.

§73-3. Permits Required.

Notwithstanding any provisions to the contrary established in the Uniform Construction Code and as permitted by Section 403.102(1) in its entirety, permits shall be required for:

a. replacement of existing siding (403.62 (c) (1) (XIII)) and roofing; and

b. installation of an uncovered deck where the floor of the deck is no more than 30” above grade (403.62 (c) (1) (XVII)).

Section 2. The following Chapters the Code of Ordinances of the Township of Upper Southampton are hereby deleted in their entirety:

Chapter 56 titled “Building Construction”

Chapter 57 titled “Building Construction, Residential”

Chapter 88 titled “Electrical Standards”

Chapter 90 titled “Energy Conservation”

Chapter 105 titled “Fuel Gas”

Chapter 117 titled “Mechanical Standards”

Chapter 130 titled “Plumbing”

Section 3. This Ordinance shall be effective five (5) days after the date of passage of this Ordinance.

Section 4. If any section, subsection, sentence or clause of this Ordinance is held, for any reason to be invalid, such decision or decisions shall not affect the validity of the remaining portions of this Ordinance.

Section 5. It is the intent of the Board of Supervisors of the Township of Upper Southampton that the provisions of this Ordinance shall become and be made a part of the Code of the Township and the sections of this Ordinance may be renumbered or relettered and the word “ordinance” may be changed to “section” or “article” or such other appropriate word or phrase in order to accomplish the intention of the Board of Supervisors.
